GDPR (The General Data Protection Regulation) is the most significant change to data protection regulation in the EU in the last 20 years, and provides a shake-up in how data can be processed and utilised by companies in response to technical changes in business in that time.
You have heard lots of buzz and questions about GDPR, as the regulation comes into effect on 25th May 2018, and at this point, business is expected to be ready or face penalties for non-compliance.
So, you know it’s about data, which is all information you hold in your business about a data subject, this may be a client, and employee or a supplier contact. The Data Protection principles were originally based on the EU Regulation that gave rise to the Data Protection Act 1998. This was to ensure data was processed fairly, proportionately and that access was given to data subjects to request records.
The new regulation sees a power shift to give more control to data subjects – such as customers, and now evolves to include the right to be forgotten.
As businesses, we need to ensure customer data is gathered with consent in a clear way, permitting contact from your organisation. You may retain that customer on your database until they ask to be removed.
So, what are the implications of a business breaking the rules?
Firstly, huge fines, these fines can be up to 4% of the global turnover of a large company.
The smaller companies need to watch out to, as the ICO (Information Commisioners' Office) have the power to impose fines regardless of business size.
You might find that the rules are not entirely new to you and you have been using good data practice since you first collected and used customer data, but there is likely to be some level of update and review required.
